Do you get 1099 for workmans comp?
Being paid by on a 1099 basis means you are an independent contractor, basically self employed. The amounts that would be paid by an employer for his employee are now your responsibilty, like the employer portion of FICA (7.56%). However, as someone self employed, you probably aren't covered by WC protection, and certainly not Unemployment, so you won't be making contributions to it. It's probably negotiable. But just because a company pays into WC for you doesn't make you an employee. Many states are "ladder states," meaning liability follows up the ladder until someone can pay. In Texas, General Contractors are required to carry Comp for their subcontractors (who are 1099 workers) who don't have it, or remain liable if they don't (since TX is the voluntary Comp state.) If you can carry your own WC, it may make you more marketable. You can check with those you do work for before you decide.
What is the difference between an employee and an independent contractor?
A small business person may be an independent contractor, meaning only that he or she sells services for a fee, as opposed to being an employee (which is distinctly not "independent"). An independent contractor refers to anyone selling you services (often a corporation or LLC, but also any small business), as long as it is not a joint venture or employment relationship.

First off I do not understand why no one that has a workers comp claim doesn't not go get a comp lawyer. workers comp pays for the comp lawyer. I would call the insurance company and ask why. then go get comp lawyer.

It may if you are driving a company vehicle and are on company time. However, if you are driving your own vehicle and are simply going to or coming home from work, the only coverage you have is your vehicle insurance.

If your claim has been satisfied, you have no grounds for taking them to court.
Of course, if you are dissatisfied you could always make representations to the company who paid your claim. Maybe they will reconsider. However, it is likely that they will have already asked you to sign an agreement that you would accept their settlement figure as full and final settlement of the matter. If you have already signed such an agreement, you have signed away your right to contest the matter further.
But if you haven't signed a 'full and final settlement' agreement, and if the settlement received is less than you are legally entitled to, or your claim is for something else that has not yet been settled, you can sue for anything that is still due to you.
If you feel that the settlement you have received is inadequate, seek independent legal advice.

How do you find out if you are getting your workmens comp?
The applicant will receive a letter informing them that their claim has either been denied or approved. If the claim is denied the letter will include instructions on how to file an appeal. If the claim is approved, the letter will state the amount awarded, when benefit payments will commence, and other pertinent information. In some cases a letter of an approved claim is sent and then additional correspondence explaining the program will follow.

Typically, Code 9012 is used in conjunction with building maintenance operations which are classified to Code 9015. For purposes of this scope, professional employees are defined as those who engage in one or more of the following operations: the collection of rent; showing vacant dwellings; preparing rental contracts; and overseeing the maintenance and security of the building or grounds. Professional employees who engage in maintenance or repair work or security operations are to be separately rated. It should also be noted that division of payroll is not available for employees engaged in duties contemplated by Code 9012 and operations described by another classification. Under these circumstances, the employee's wages are assigned to the higher rated of these two classes. Code 9012 is not available for an insured whose principal business is described by a Standard Exception such as a financial entity assigned to Code 8810-Clerical.

I would contact the Fair Trades Ombudsman and sue if my boss sacked me for claiming workers comp if I was injured at work. I believe it is very illegal for an employer to do this.
Yes, you can be fired after you file a WC claim, but not BECAUSE you filed. IF your performance, absenteeism, misconduct earned you discharge, WC does not prevent it.

I found looking for information on websites set up by lawfirms that deal with workmen's compensation issues very helpful.
The workmen's comp. settlement will depend on the impairment rating given to the, in this case, index finger by the doctor when you are released from his/her care. I know from experience that the doctor may not tell you, so in this case you need to find this out from the insurance company that covers your work injuries. In IL, it varies slightly in certain states, an index finger is worth 40 weeks of benefits if it is permanently partially disabled, as is the case with my husband, and he received a 5% impairment rating. It is important to note that there are several types of Permanent Partial Disability and that total loss of use of an index finger is worth 46 weeks.
Concerning Weekly Benefits: You are entitled to 66 2/3% percent of your average weekly wage during any period of time you are unable to work because of the injury. This payment is tax-free and is based on the average weekly earnings during the 52 weeks prior to the injury.
So, to calculate his particular settlement, I first calculated 5% of 40 weeks (5*.40)=2. My husband's weekly wage was $560, so 560*.66(2/3)=246.40. He was gone 7 work days, so 246.4/5=$49.28/workday, so 246.4+98.56(49.28*2)=$344.96 and then you take 344.96*2=$689.92
Additionally, employees are entitled to compensation for disfigurement (scarring).

You can move wherever you'd like. In a worker's compensation claim filing in which the employee resides in one state, was injured in another state, and is employed by a firm in yet another state, the employee can select which state's benefits are most generous. I was hired in Illinois, work in Wisconsin, and get injured in Michigan. Say Michigan has the best worker's compensation benefits, I can then select to file claim to Michigan standards, and the employer would be statutorily required to compensate the prescribed benefits.
