We have a situation at our company right now that an employee who has been out for over a year receiving work comp payments and is working under the table jobs and for another company. We were notified of this information by an anonimous caller. If you know of someone doing this I would recommend you call the company they are receiving work comp checks from. You can even send a letter. It is very likely that the company is having it investigated but has no ideas on where to start or even look to see if the person claiming is scamming. It is my understanding that the strict answer to this is an absolute "NO"--- unless that person has as their principal duty on the job the task of playing basketball. In those cases, the individual's own insurance policies would cover any injury; and, if that individual was precluded from working as a result, the employer would treat their absence as any other instance of missing work due to accident off-site.
