It hard to answer your question as it is not clear enough but I will try. I am assuming this 16 y/o is not your son and his father is an illegal alien. Unless the court has given you custody of your step-son then the father is not liable for any support. If YOU DO have custody then yes, he will have to pay and if he does not he can then be deported after being thrown in jail for non-support and contempt of court. That is up to ICE (INS). If YOU DO NOT have custody then you would obviously have to petition the court for it and wait for their decision. It depends on the criminal convictions. If the alien was sent to "prison" which means a sentence of a year or longer, then more likely than not they are subject to a deportation hearing. If the alien was sent to jail which means less than a year sentence, than there is a good chance they are not subject to deportation and you can refile an application for permanent resident status.
