Can amount on line 12d on w2 form be subtracted from total income?

If the code number is D in box 12 the amount is deferred compensation an would not be included in the Box 1 Gross wage, salaries, etc for the year.

You cannot subtract it because it has been left out of your gross wages for the year and is not subject to income tax as long as it is in this deferred compensation plan.

The amount will be subject to income tax when you start taking distributions form the deferred compensation plan.

The code numbers for the W-2 form box 12 may be on the back of one of the copies of the W-2 form that you have in your hand.

Go to the IRS gov web site and use the search box for W-2 go to page 7

How much will you owe in taxes if you made 10888.00 last year in mineral rights royalties and worked and no taxes were taken out of your paychecks and you live in Fort Worth Texas?

Mineral rights royalties are paid to you by a person/company in exchange for a lease for mineral extraction. Mineral rights royalties are reported on Schedule E (Supplemental Income and Loss). Since the amount of your wages wasn't included, taxes are figured only on the mineral rights royalties.

The royalty amount of $10,888 is reduced by $5,450 standard deduction for 2008 ($2,700 for 2009) and $3,500 personal exemption for 2008 ($3,650 for 2009). The result is $1,938 taxable income for 2008 ($1,538 for 2009). The tax is $194 for 2008 ($154 for 2009).

The tax will be reduced if your royalty income is reduced by any expenses, such as depletion.

But the tax also will be increased by the increase in your taxable income with the addition of your wages. If no income taxes were withheld and you were issued a Form 1099-MISC (Miscellaneous Income), then you're considered self-employed. You'd file Schedule C (Profit or Loss from Business) or Schedule C-EZ (Net Profit from Business). That income would then be reduced by expenses (advertising, business mileage, etc.).

For more information, go to www.irs.gov/formspubs for Publication 535 (Business Expenses). Also go to www.mineralweb.com for articles on mineral rights royalties, depletion allowance, etc.

Is a federal CSRS annuity considered an employee retirement system for Maryland State Tax purposes?

CSRS is Civil Service Retirement System. Form 502 is Maryland Resident Income Tax Return. Subtractions from Income includes Pension Exclusion, which allows you to subtract some of your taxable pension and retirement annuity income.

To apply the Exclusion, two conditions must apply. One, on the last day of the tax year, you were age 65 and above orcompletely disabled or your spouse was completely disabled. Two, the taxable pension/annuity included on your federal return was from an 'employee retirement system'. Form 502 defines employee retirement system by what it isn't. It doesn't include an IRA (traditional, Roth), a Keogh Plan, a simplified employee plan (SEP), or an ineligible deferred compensation plan.

What do you do if you wrongly get a 1099?

If you received a 1099 instead of a W2 form for your United States income tax, you received the form for an independent contractor instead of the form for an employee. First. You should ask your employer for a corrected form. Frequently that will solve the problem. Second. Hopefully, you kept your pay slips with the lists of your deductions. Third. If you have everything in order and so far nothing has been solved yet then contact the Labor Department.

How much would the taxes be on a 2 million dollar dream home in Sonoma California?

For Single filing status, 2008 tax is $678,597(2 million multiplied by 35 percent minus $21,403).

For Married Filing Jointly, 2008 tax is $671,575 (2 million multiplied by 35 percent minus $28,425).

For Head of Household, 2008 tax is $675,409 (2 million multiplied by 35 percent minus $24,591).

The actual tax liability would be more or less depending on your other income, any income tax withheld from your other earnings, etc.

This answer is incorrect if you are referring to PROPERTY TAX, and property tax rates are different in each County. Most counties in California on avg are in the 1.5% range but along with that, there are other factors that must be taken into consideration.

Because Sonoma County uses a complicated formula to determine the property tax owed on any individual property, it's not possible to condense it to a simple tax rate, like you could with an income or sales tax.

You can rest assure it wouldn't be the high rates given in the answer above. This person must have been looking at something different and not property sales tax

Can you make corrections to your income tax return once filed?

Yes and you can use the below enclosed information for this purpose.

To correct an error on the original filed income tax return you will have to use the 1040X Amended Individual Income tax return available by going to the IRS gov web site and using the search box for 1040X

File a separate Form 1040X for each year you are amending. Mail each form in a separate envelope. Be sure to indicate the year of the return you are amending on the front of Form 1040X.

The 1040X form now has just one column where the Correct Amount is the only figure entered, making it easier to make changes to previously filed returns. There is an area on the front of the form to explain why you are filing Form 1040X. Generally, to claim a refund, Form 1040X must be filed within 3 years from the date of your original return or within 2 years from the date you paid the tax, whichever is later. Returns filed before the due date (without regard to extensions) are considered filed on the due date.

Attach copies of any forms or schedules that are being changed as a result of the amendment including any Forms W-2 received after the original return was filed.

The correctly filled out 1040X amended individual income tax return will have to be mailed to the correct IRS address and you can find the address in the instructions for the 1040 tax form.

Normal processing time for Forms 1040X is 8 to 12 weeks from the IRS receipt date.

Please Note: Your state tax liability may be affected by a change made on your federal return. For information on how to correct your state tax return, contact your state tax agency.

If you don't owe any taxes do you have to file for an extension just to file the paperwork after the April deadline?

No, you don't need to file an extension if you don't owe the IRS any money. You only need to file an extension if you need more time to pay.

The current law is you have three years to file for a refund and after that you forfeit it to the IRS. The IRS does not charge penalties to people that are owed refunds even if they are filing after due date (usually April 15). Just make sure you file within the 3 years.

But if you owe money, even if you file an extension, if you do NOT pay by April 15, then you will owe interest and penalties on the money you owe. The extension is form 4868 and can be filed online through IRS.gov e-file, or by mailing in the form. The extension is NOT an extension for time to PAY, it is just an extension for time to file.

Even if you are owed a refund, the IRS says that you are "required" to file if you made over the standard deduction. But in all reality, if they owe you money, they don't want to see you get it. If they owe you money, they don't care when or if you file, but they do like to keep tabs on you. There will be no penalties.

Can stock market losses be claimed on your income tax return?

Yes. A loss means that the stocks were sold for less than their basis (usually what you paid for them). You need to know what you paid for them and at what price they were sold. You also need to know whether the stocks are short-term (prior to the sale, you had them for one year or less) or long-term (more than one year). These losses are deductible and are reported on Schedule D (Capital Gains and Losses).

What is available to Ch 11-er's?

We filed chapter 11 in 1999. We were just pre-approved for a home loan a few weeks ago and close on our house October 21st. Our bank didnt even question the bankruptcy. I do think the bankruptcy has to be at least 2 years old but you should check with your lender first. There are tons of loan programs out there so dont count yourself out just because of a bankruptcy. Good luck!

In Indiana if a person rents a machine for a day but doesnt return it for several weeks occasionally sends in some money but never gets current wont answer his phone or return call what options?

Refer to the wording of the rental contract and what it specifies. There IS a contract, isn't there? If so, you can probably legally re-possess the machine for non-payment of the rental fee. If no contract, you may have to proceed a little differently and get a court order to retrieve your property.
