How long does it take to receive workers comp settlement check?
That last answer was inaccurate. In South Carolina, we settled on the 1st of September and it is now the 23rd and still nothing. Once the lawyer receives the check, it will sit in trust for 10 days and then WE will get our cut. Honestly, I say someone is trying to get some interest payments off of our money before we get it. Sad, we are the ones suffering. Not the insurance company or the lawyer.
within ten days of the decision.

Put in a complaint to the Bar Association in your area and be sure your letter is concise and to the point. They will probably give you a time to meet with you and discuss your problem with your lawyer. Lawyers can be sneaky, so be careful. If you have received any letters or forms from your lawyer each one of those is a cost to you. Letters or documents that come from lawyers are never handed to their client for free. Some letters (depending on what it is about) can cost $75 and up. Be sure you have all correspondence from your lawyer in a file to take to the Bar Association. Be sure you have your facts straight! Good luck Marcy

What is productivity bargaining?
A form of collective bargaining leading to a productivity agreement in which management offers a pay raise in exchange for alterations to employee working practices designed to increase productivity
Productivity bargaining has been described as "an agreement in which advantages of one kind or another, such as higher wages or increased leisure, are given to workers in return for agreement on their part to accept changes in working practices or in methods or in organization of work which will lead to more efficient working. The changes in the interests of efficiency are seen as an integral part of the bargaining and as necessary contribution to meeting the cost of advantages conceded to the workers."
The prime purpose of productivity bargaining is to raise labour productivity and lower unit labour costs, and this is achieved by the exchange of alternations in working practices for increased leisure, higher remuneration for labour, more comprehensive fringe benefits, and general increase in the status of manual employees. Moreover, it is an exercise in problem solving and creating new gains, rather than just power bargaining over shares.
Productivity bargaining is a complex process. It involves lengthy, detailed negotiations about the implementation of a variety of management techniques such as work study and job evaluation. The content of negotiations is more or less comprehensive in the sense that it includes not only bargaining over earnings but bargaining over other related matters such as reductions in hours, introduction or extension of shift working, manning of machines, demarcation lines, the introduction of new payment system, and re-allocation of job control. In addition, the coverage of productivity bargaining is more or less comprehensive in that generally speaking it will aply to all employees in an enterprise. Productivity bargaining generally occurs at the level of the enterprise or company.

Check your policy. On the declarations page, under "States" and "Other States" you will see the states you have coverage in. Usually, if your exposure out of state is very short term and not regular, you won't have an issue. However, the only way to be certain is to report your other state exposure and ask that under "Other States" you either have specific states listed or a statement like "All except monopolistic." The declarations page is the one with your name, address, effective dates, coverage and premium. Monopolistic states require that you purchase Workers Comp (WC) insurance from them - so your WC carrier will not be able to list those states.
It depends on the state you live in. If you live in California and the injury occured at work an you then were in an accident yes you can apply for workman comp as long as you reported the injury to the proper personnel the date the injury occured.
