a) If the mistress knows he is married;

b) The mistress has no idea that he is married;

You need to file a divorce in your state court. Only a court decree can legally dissolve a marriage in the US. You will be required to notify your spouse of the filing.

Answer I've know people who have lived together for over 10 years before marrying but if you are in a rush to get married, why not ask the guy you are with, what his intentions towards marriage are? Does he ever want to get married and if he says no and that's not what you want, then at least you now know that you have two options, one would be to accept things as they are, and the other would be to move on to a guy who will want to marry you.
