I am a student and on 2 different occasions my confidentiality has been breached could you tell me what rights i have and can i sue if a member of staff because they have breached my confidentiality?

If you mean that a confidentiality STATUTE was violated, then you can use the statute's enforcement mechanism, which probably does not start withn a lawsuit, but with a complaint.

You probably can never sue an individual employee, only charge the school IF you prevail on the charge.

Can you physically defend someone if a police officer is using excessive force?

No, you can't. The best action may be for everyone to calm down and stop struggling. If you jump into the fray while an excited police officer is trying to subdue a suspect then you will be charged and possibly injured. Unfortunately, some police officers do use excessive force. People in some areas need to modify their behavior so as not to attract police attention by being intoxicated in public, violating traffic laws, not engaging in combat or domestic disputes with others, and not interfering when the police are trying to quell a disturbance.

Does past mental illness affect child custody?

Depending on the severity, mental illness or a history of mental illness could be a factor in a court declaring the parent unfit, if the illness could result in an unsafe environment for the child. The parent should have good legal representation in any action that will result in their being declared unfit.

The factors used to determine that a parent is unfit are generally governed by state laws with child endangerment being the determining factor. The following include some of the reasons a parent may be declared unfit:

  • physical, emotional and sexual abuse
  • excessive discipline
  • failure to protect the child from abuse by others
  • failure to report abuse of the child
  • neglect- failure to provide food, clothing, proper hygiene, necessary medical treatment, schooling
  • failure to provide proper medical care
  • failure to provide day to day parental care
  • serious illness or disability
  • mental illness
  • substance abuse or addiction
  • alcoholism
  • criminal activity and/or associations
  • incarceration
  • conduct or conditions that are seriously detrimental to the child
  • abandonment
  • child endangerment
  • leaving the child unattended or in the care and supervision of a child or otherwise incompetent person
  • a failure to provide adequate supervision
  • unsafe living conditions
  • a medical condition that makes it impossible for the parent to adequately care for the child.

When can civil rights be taken away?

If the state believes you are involved in certain crimes including, but not limited to, drugs, insider trading, RICO violations, terrorism, domestic violence etc., they can suspend your civil rights prior to trial, and in some cases, are not compelled to give you a trial.

Some of their criterion has been a bit broad, thus a small amount of marijuana on a citizen's property has been grounds for total asset forfeiture prior to a trial, or even an arrest. Or "terrorism" can be claimed if one has donated to a non-profit that itself may have donated to another group that may support or encourage terroristic activities.

Little known generally, but of great concern to our troops, is the loss of their right to bear arms if a civil protective order is upheld against them. Thus with no jury trial or criminal conviction, a policeman or soldier may be discharged from all duties, as being no longer able to serve.

What is the difference between a Notary Public and a Commissioner of Deeds?

A notary can only act within the state which appointed them. Commissioners of deeds are appointed by a certain state to "notarize" signatures in another state or foreign country, for documents to be used in the appointing state.

For example, a Florida notary public can only notarize signatures in the State of Florida. If the Governor of Florida appoints a Commissioner of Deeds for Mexico, then that Commissioner of Deeds can notarize signatures in Mexico, only on documents that are going to be used in Florida.

This is how it works in most states, except in New York City, where a Commissioner of Deeds is the same as a notary but may only act within New York City, whereas a notary in New York can act throughout the state.

In 1964 and 1965, the US Federal government passed to laws that helped Black Americans from being discriminated against. This law was not sufficient, however, to make sure all people, especially Afro Americans, from being disenfranchised at the polling booths.
