Repossession

Seizure of property bought on credit for which loan payments are not being received. Please note that when asking a car repossession question, it is often useful to include the state that you live in. This will enable people to give you better answers.

If your fiance and you just bought a car as joint ownership and are now splitting up who keeps the car if both of your names are on the title but his name is listed first but you're making payments?

You could sell the car and liquidate the vehicle. Or transfer title through the local county courthouse to just one of you, but remember that currently both of you are financially responsible for vehicle and the monthly payment is reflected on both of your credit reports-(ie) wether payment made on time or not. It matters not whose name comes first on the title, but how the title is worded. If the names are separated by "and" each person owns the vehicle equally and an equitable arrangement will need to be made, or petition filed with the court for partitioning of said property. If the names are separated by "or" each person owns the entire vehicle and the person who has possession can take the action they so choose. A lending agreement that is joint is owed by both, if only one person is on the loan, but both are on the title the issue of ownership will more than likely have to be decided in a civil or small claims court.

Can your car be legally repossessed without prior notification after a chapter 7 bankruptcy?

Probably. Only a few US states require the lender to give the borrower a "Right To Cure" notification before recovering the vehicle. All other states allow repossession with the only requirement being a breach of peace cannot occur. Wisconsin is the only state that requires a replevin order. Vehicles are considered secured debts and are not dischargeable in bankruptcy, therefore, the BK would not be relevant.

Should you have a mechanic check out a car before you buy it?

== Mehcanic inspection== It's best to have any used car inspected by an independent mechanic before you buy it. For about $100 or less, you'll get a general indication of the mechanical condition of the vehicle. A pre-purchase independent car inspection is a good idea even if the car has been "certified" and inspected by the dealer and is being sold with a warranty or service contract. A mechanical inspection is different from a safety inspection. Safety inspections usually focus on conditions that make a car unsafe to drive. They are not designed to determine the overall reliability or mechanical condition of a vehicle. To find a pre-purchase car inspection facility, check your Yellow Pages under "Automotive Diagnostic Service" or ask friends, relatives and co-workers for referrals. Look for facilities that display certifications like an Automotive Service Excellence (ASE) seal. Certification indicates that some or all of the technicians meet basic standards of knowledge and competence in specific technical areas. Make sure the certifications are current, but remember that certification alone is no guarantee of good or honest work. Also ask to see current licenses if state or local law requires such facilities to be licensed or registered. Check with your state Attorney General's office or local consumer protection agency to find out whether there's a record of complaints about particular facilities. There are no standard operating procedures for pre-purchase car inspections. Ask what the inspection includes, how long it takes, and the price. Get this information in writing. If the dealer won't let you take the car off the lot, perhaps because of insurance restrictions, you may be able to find a mobile inspection service that will go to the dealer. If that's not an option, ask the dealer to have the car inspected at a facility you designate. You will have to pay the inspection fee. Once the vehicle has been inspected, ask the mechanic for a written report with a cost estimate for all necessary repairs. Be sure the report includes the vehicle's make, model and VIN. Make sure you understand every item. If you decide to make a purchase offer to the dealer after considering the inspection's results, you can use the estimated repair costs to negotiate the price of the vehicle. The Buyers Guide lists an auto's 14 major systems and some serious problems that may occur in each. This list may help you and your mechanic evaluate the mechanical condition of the vehicle. The list also may help you compare warranties offered on different cars or by different dealers.

How many payments do you have to be behind before they can repo your vehicle legally?

Read your contract. It likely says that anytime you are in DEFAULT, the collateral may be repossessed. That means ONE (1) day. NOT months, weeks or payments. LENDERS AND BANKS ARE TAKING MANY CHANCES IN THIS ECONOMY.

Can you find my car by the VIN if it was stolen or repossessed?

There are certain strict procedures that an automobile repossessor must follow when he is repossessing your car. The repossessor must notify the police that such vehicle is being repossessed, you did before or after the repossession has occurred. In either case, the police should know right away that the vehicle was repossessed. If this is not the case, then the vehicles like to have been stolen.

What is the best car to buy?

The best car to buy depends on what use it will be put to and a host of other things, too. What is the 'best' car for one person may not be for another. An additional factor can be what is the best car to buy when the availability of funds is a factor. As an example, if one needs a vehicle for use in "off - road" activities the choices range from a Jeep Wrangler to a top of the line Range Rover. The former being less expensive then the latter.

Can you get a car out of impound by transferring the title in Iowa?

Cannot be answered because the reason for the impoundment is not disclosed. However . . probably not - ESPECIALLY if the vehicle was seized as the result of a narcotics confiscation.

Can a dealership force you to return a vehicle if you already have a signed contract?

Spot Delivery Car Dealer ScamSounds like you may have been a victim of a "Spot Delivery."

Car dealers will sell you a car and assume that you will be able to qualify for a loan. They will have you sign all the paperwork, take delivery of the car and you will believe you just bought a car. The dealer knows if they don't take a chance and put you in a car, the next dealer you visit will. They can now use this additional time to try and get your car loan "bought" by a lender.

If the dealer cannot secure financing for you, they have no choice but to call you and have you bring the vehicle back to them. You most likely signed a different form amongst all your other paperwork that states you will bring the car back if financing cannot be arranged.

To make matters even worse, the deal is not final until you and the dealer sign the contract, of course you sign the contract first then the dealer signs it later after it has been approved. Most car dealerships will not give you the copies of the paperwork you signed if you're not officially approved for a car loan.

Why is a 6 volt battery larger than a 9 volt battery?

Nine volt batteries are actually 6 AAAA batteries. They have a higher voltage but a very low current capacity.

6V batteries are usually used in lanterns. As such they are a modest voltage but can source a fiar amount of current for a long period of time. This is why they are larger.

9V batteries can supply higher voltage, but the larger 6V batteries can supply much more power.

Another AnswerThe word "battery" means a collection of cells, where each cell generates a voltage according to its particular chemistry. To get more voltage, you put more cells in series. So, for example, your ordinary two-cell flashlight runs on 3 volts made from two 1.5v cells. A 9-volt radio can run on 6 1.5 volt cells. A 12v car battery is actually made from six 2-volt lead/acid cells, or similar.

The size of cells determines how long the chemical reaction will generate the proper voltage: the larger the cell, the longer it lasts. So you have standard sizes of AAA (short life), AA (slightly longer), C (much longer) and D (longest); all 1.5 volts.

When purchasing special-purpose cells ("batteries") where you have a choice, you may want to also compare the "ampere-hour" numbers, or milliamp hours (mAh), where the larger the number the more power you will have.

If your boyfriend buys you a car do you have to return it if you break up?

If it was a gift, no. But if you have paid for it in some way he'll be able to argue in court that it wasn't a gift. In any case, the ethical thing to do would be to return the car if you break up, especially if you initiate the breakup.

What is the typical lifetime of the car itself?

A car can easily last 30-40 years and there are vehicles that are 100 years old. Typically I would say 20 years is about normal.

Can a title loan company put a lien on your car without you signing the title?

Hell no!!!

The above answer is wrong:A lien is just a legal way to insure you can not sell your car without settling you debts.

A lien can be filed against any "real" property that you used as collateral like a title loan or any real thing a tradesman worked on. Like a Car or RV or House if they repaired the roof or something.

Can you return a used car after purchase in Michigan?

In no state is there a law automatically allowing you to return a car just because you want to (not even if you change your mind the next day).

That said, you could talk to the dealer. He doesn't have to allow you to return the car, but he's not forbidden to allow you to return the car either, if you can make it "worth his while" to let you do so.

Can a lender file auto theft charges if they want to repo your car and do not know where it is?

It depends on your state laws what it is called.Usually not called 'auto theft" but isn't that what it amounts to?Here is a NC law I had open at the time.§ 14-115. Secreting property to hinder enforcement of lien or security interest. Any person who, with intent to prevent or hinder the enforcement of a lien or security interest after a judgment or order has been issued for possession for that personal property subject to said lien or security interest, either refuses to surrender such personal property in his possession to a law enforcement officer, or removes, or exchanges, or secretes such personal property, shall be guilty of a Class 2 misdemeanor. (1887, c. 14; Rev., s. 3436; C.S., s. 4288; 1969, c. 984, s. 3; c. 1224, s. 1; 1987 (Reg. Sess., 1988), c. 1065, s. 2; 1989, c. 401; 1993, c. 539, s. 57; 1994, Ex. Sess., c. 24, s. 14(c).) (2) If that maximum punishment is more than 30 days but not more than six months imprisonment, it is a Class 2 misdemeanor; and

Can your car be repossessed if your chapter 13 was discharged a few months ago and you made car payments after the discharge and one was returned uncashed?

If the Chapter 13 is dismissed and the loan is not current, then yes they can repossess the car. By "current," I mean go back to the day you originally bought the car. If you were supposed to pay $250/mo since then, if $250/mo has not been paid since then, it is behind and they can repossess. In other words, if they did not get a payment for 6 months while you were in the Chapter 13, then that car is 6 months plus late fees behind, all of which must be caught up or they can - and usually will - repossess the car. Please note that nothing in this posting or in any other posting constitutes legal advice; this is simply my understanding of the facts and law, which I do not warrant, and I am not suggesting any course of action or inaction to any person. Speak to a lawyer for specific advice. If you have any questions, please refer to a lawyer in your jurisdiction. Thanks! Only if the creditor got a relief from stay in your chapt.13 bankruptcy.Otherwise, they have to wait until your case is closed by the court, not just dismissed.

Can you buy a car in California without pink slip just a bill of sale from a private party?

Not a good idea. What if the guy doesn't really HAVE the pink slip? What if he owes a lot of money to the bank and that's why he can't get the pink slip for you? What if he has sold it to someone else and given THEM the pink slip and you just get a bill of sale? No, go to the DMV and get a replacement title and have him sign it over THERE. ----------------------------------------------------------------------------------- Do not ever buy a car without a "clean" title (without liens). I am not sure what the law in CA is but cars that are 20 years or older do not require a title in many states. Y-THINK-Y

Why is your car hesitating when accelerating and decelerating Transmission checked and is fine but the car still hesitates why?

Brakes may holding the free ride of the car back. The decelerating makes me think this.

i have a different answer if you just mean the car is hesitating to go. like u give it gas and it just wont get the power to take off, it will get up to speed, but only after like half a mile.

1. it could be your sparkplugs/sparkplug wires, if they are correded or just worn out, they won't produce a sufficient spark which will not ignite the fuel in the combustion chamber, which means either you wont go, or you'll "creep" up to speed from the little sparks you're getting. could also be a sparkplug wire problem, i suggest cleaning your sparkplugs first, then trying(remember to do them 1 at a time to prevent misplaced wires, huge problem if you do)or just buy them at an auto store. i just bought 8 for $15. cheap easy fix. if that dont work try the plug wires.

hope it helps

How should the rotor be pointing when replacing the distributor on a Lincoln Town Car?

With any dist type ignition system you should have put back the dist pointing in the direction it was when you pulled it out. But lets say you forgot or someone cranked the engine over. Just find where Number one cylinder is. Its usually the one on the head that is farthest forward. If not sure check the shop manual or goto a parts house and maybe there is a ford/mercury/Lincoln repair manual you can peek at. Okay remove the sparkplug for hole number one. Disconnect the coil wires...any will do so that it will not shock you. Crank the engine and you should hear a HOOSHING noise. That's cylinder number one on the compression stroke. AS you doing that check the fromt harmonic dampner and you should see the timing mark go by just as its "HOOSHING". When the engine is about to go hoosh the timing mnark should line up to the timing tab at zero degrees. Now just plop the distributor in and line up the rotor and have it point to number one ignition wire. If the distributor does not fall in its because your oil pump shaft hex shaft did not line up. Just adjust it by turning it ever so little. Slam dunk the distributor in and your set.

Second way is to remove the valve cover where number one is and crank the motor to view number ones rocker arms. Just crank till you see a pattern.....you want to see intake rocker open the valve...then close...the piston is at TDC...then the exhaust will open then close....piston comes up again...then down...intake is going to open..when it closes..its at TDC - check your harmonic dampner to confirm. (tdc = top dead center)

The bottom line is it really doesnt matter where the rotor points as long as its pointed in sync with the ignition wire its suppose to fire at the right given time. In the interest of keeping the factory wires "tidy" we strive to keep it as oem (original equipment manufacturer) as possible.

If the repo guy forcefully took your car keys and drove away with the car how do you retrieve personal items from the car and how do you get your keys back?

I am a repo agent and this is how our company handles it but there are many different policies and regulations across the nation so do keep that in mind. I allow the debtor to retrieve their personal effects when they surrender the keys. most companies will allow you to get your stuff at no charge if the keys are surrendered but some do charge a storage fee for inventory of such possessions. our state gives ninety days and then the items are disposed of. you may have to do a little research of your state laws and regulations though. personally i think this agent should have let you have your stuff UNLESS you were threatening or abusive. good luck though. As for you personal items, those can be retrieved from the tow company (go through your reinstatement with your finance company first) and when you pick up your car, you can ask there. And yes of course you can have your keys back.

This from another repo man:

There is a constitutional issue involved in repossesions that most repo agents and vehicle owners are not aware of. The only legal way to repossess a vehicle is with a court order and by a court bailiff. In most cases "self help repossesions" are the norm. However, the language of the law is "self help repossesions" are permitted as long as there is no breaking of the peace. Therefor, if the vehicle owner states his objection to the repossesion and the repo agent proceeds to take the vehicle over the objections of the owner, this is considered as a breaking of the peace and it then becomes an unlawful repossesion, with SERIOUS sanctions on the repossesor and lienholder! So, if you are having your car repossesed , and you are present, and the repo man doesn't let you get your personal property out of the vehicle: SEE A LAWYER; you'll get a lot more than your personal property back!

Can you return a car to the bank?

I assume you bought it on payments, You can return it, BUT, That is called, Voluntary Repossesion, That is as bad for your credit as A regular repo., I suggest you sell it and pay the bank, Or, talk to the bank to see if they will take it back without giveing negative report, THIS IS HIGHLY UNLIKELY, But they can not report you for asking, If not, ask if they have A lot where they put their repo's, If so ask if you can put it there and continue making payments until it sells,,,,,, Your last option to get rid of car and still keep your credit score is,(ALL this is the question, I am not going from A question to A statement)>>>> Ask if you can get A personal loan and sell the car for what you can get,,,,,,,,,, Why would you do this? This is why>> You bought the car, Its worth $5000.00, You owe $5800.00, everyone offers $4800.00 for it, There is A $1000.00 gap to fill, You do not have A grand in cash, but you really want to get rid of car, You borrow the thousand from the bank and sell the car, give the $4800.00 to the bank, Now you have 12 payments of about $94.50 A month, You can handle that payment, and keep your credit too.,,,,,,,,,Good luck, Jamison.,,,,,,
