Is it too late to record the lein??
Assuming the "owner" has not applied for a replacement title and had a lein recorded on the replacement title through the DMV, then yes.
2 choices here.
Same results either way.
Wrong the result is not the same by not taking action. Remeber you received a loan. The company didn't by a motorcycle they loaned you money. In the case that you do not want the bike back then let it be sold at auction. More than likely you will have a remaining balance which you will still need to pay to get you credit in some what good standing. Make sure and contac the lender and let them know what you want to do.
Can a repo man repossess a car from work if the business parking lot has controlled entry?
Nope. At least not where I work. I work as a security guard for a local plant that has a security booth that is staffed 24/7. We are not allowed, by the clients rules, (I work for a contracted security company)to let repo men come on the property. We had an incident occur not to long ago. A repo man came to the main gate so he could repo a vehicle. The main gate guard told the repo man that he was not allowed to come on the clients lot per the clients rules. He got nasty and said he was going to call the police. The repo man was then told that the police are not legally allowed onto the clients property unless we or the client call and ask for assistance or the police have a warrant or the police have their lights on and are pursuing a fleeing vehicle. I was told to keep a lookout for suspicious vehicles and report any trespassers on the property. had the repo man trespassed, I could have notified the M/G and the police would have been called and arrested the trespasser. Also, I would have had plenty of help from the forklift drivers and other workers if the situation had become unsafe. The repo man never came back. You may dispute this, however I know the client rules and know what I am allowed and not allowed to do. We never got in trouble, and the cops never showed. The client, as far as we know, never talked to us or our boss about it. There was never a breach of security, so I don't think it ever went beyond our boss because it was not worth wasting the clients time. Our boss told us that we did what we were supposed to do and that under no circumstances were we to let a repo man onto the proerty. It's that simple. The above poster did exactly what he was supposed to do his job... good for you. The repo man does not have the right to tresspass on private property. This does not mean he won't try.... a repo man will lie and misrepresent himself to try and gain access to the vehicle. If the guards are not doing their job unlike the above poster then the repo guy will get your car.If the repo guy gets your car from a controlled lot it will up to the owner of the lot not you to press trespass charges against the lender and the repo company. To the poster who said repomen cannot enter private property. You are incorrect. The UCC (Uniform Commercial Code) dictates that they can. Repomen cannot breach the peace during a repo. In other words, if they are told by the property owner or legal representative to leave, they have to. If it is a "controlled lot" then it is up to the security guard to do his job. If it is just a matter of an automatic gate, then the repoman can go in as long as he does not: cut a lock, cut a fence, damage the fence, damage the lock, pick the lock. In other words, if he is "in line" to go in and someone goes in right in front of him, if he can get through before the gate closes, he is legal. The gate was open, he didn't open it and nobody stopped him. The answer to this question is NO, ONLY if the 'control" does it's job. A recovery agent HAS the right to enter private property until that right is resinded by the property owner(in this case, the security gaurds). IF security is law for whatever reason, you can lose your car. Your employer provides this protection for your vehicle to keep your car sercure from thieves, NOT for you to hide your car that you wont pay for. If you need to hide your car from a repoman, it sends a notice to the employer that you have the potential to be a problem to them also. Sorry you don't have "the right" otherwise it couldn't be recinded could it ???? You are "playing dumb"(something most repoers don't have to play at)....uh what sign?? what gate??? What I'm not allowed here???Funny how the hundreds of repo posters and moderators on this site are so quick to point out the letter of the law with others actions just not there own. The repo man cannot enter any private structure (but if your garage door is open, he probably will), damage any property, or cause a breach of peace. If he got onto the business parking lot, he can repo the car. The guard may have let him in knowing why he was there or he may have just said he was there to pick up a vehicle and the guard assumed he was taking it for repair. After all, the sign on the truck probably said XYZ Repair, not XYZ Repo.
How would a person with a joint car title get it transfered to their name only?
The other person needs to sign it over, selling his/her share of the car basically.
Can a car be sold if the loan is not paid off?
You can sell the car but the balance of the loan must be paid at that time.
At the time of the sale when you know you will be receiving funds, call the bank and ask them for a "10-day payoff" this is the amount owed to pay off the loan 10 days from now.
Once you sign the title over to the buyer and receive the money, You are obligated to pay off the car at your bank. You want them to get the money within 10 days so you don't end up owing more than the "10 day payoff" you requested. Interest accumulates daily so that's not a big deal anyway.
If you do not pay the car off at the bank, when the person tries to title the car in their name, it will come up as "Lien not satisfied" in the states' database and they will not be able to register the car in their name.
Is not paying a pawned car title of 300 hundred or more a felony concealment charge in GEorgia?
who put in thought ya might be interrested in this
What legal trouble can you get into for selling a car for parts but has a lien on it?
A lot. Legally whoever has a lien on the vehicle owns the rights to it until your loan/balance due is satisfied.
You have no legal right to sell the car in the first place because you do not own it and would have to be an utter fool to do this.
What is 16020 of the California vehicle code?
Failing to provide proof of financial responsibility when operating a vehicle
How long do you have after purchasing a used car to return if you decide you do not want it?
You better have decided by the time you sign the contract, because after that you can't usually return it. In most cases the contract will state this in bold letters so you can't later claim you were misled about it.
Some states require used car dealers to offer buyers the option to purchase a recission period (a short one, usually 3 days) during which they're allowed to change their mind and return the car. Note that I said "option" and "purchase" there. If you didn't purchase the option, then you don't get to return it.
If your financed car was totaled is there any way you can keep it and fix it?
When you retain an totalled vehicle, you receive a little less in your settlement amount. If this amount is enough to pay off your vehicle, you can keep it, but you will not receive your part of the settlement, if any, until after you have the title & it is released from the finance company. Also, the state regulations on retention of total loss vehicles needs to be checked.
each person is responsible for their own car until the titlework has been transferred at a vehicle title office.
as long as you have returned the car as requested. A dealer may try to keep a deposit, however most states allow for reasonable costs, re-washing,(detail) anybody or physical damage that wasn't there before and maybe miles but the law is very clear as to use and intent. drive the car for 5 days and put 15000 miles on it and you will probably lose, drive normal miles 500-2000 this would be normal. Most dealers will not retain deposits if the financing is turned down, it's not legal and it's bad business. There is a non-refundable deposit kind of deal, special order, last one in stock, these kind of deposits can and will be kept by the dealer.
If car title is lost but you cant get title because ex is still on title?
I bought a car and I cant get the title for it what to do
He is not required to write anything stating that you are buying "as is". That is assumed. Unless he stated in writing or verbally that he is selling the car with a warranty, you are probably out of luck. Of course you could take him to small claims court. If you could prove that he knew the car had a problem and hid that problem from you, you may prevail. New cars have problems, why would you expect it to be different with a used car. There is an old saying, "Buyer Beware".
Do house and car keys contain toxic levels of lead?
Another person wrote: "I have never heard this one before. I think it is very unlikely as lead is a very soft metal and would not be able to withstand the constant turning of the key before it wore away and the key would be totally useless. This is so unlikely it is not even on www.snopes.com as an urban myth."
However, toxic levels of lead in house and car keys is common. Please see the following fact sheet for families and DO NOT let your children chew on or play with keys!
http://www.ucsfchildcarehealth.org/pdfs/factsheets/leadinkeysen011804.pdf
Lead may also be present in many common household objects from miniblinds to costume jewelry to powercords. It's dumb for countries to allow lead to be used in these items, but of course we get even dumber the more lead we use.
What is the difference between freon and anitfreeze for a vehicle?
"Freon" is the product name of the refrigerant GASused in air conditioning systems. Freon is compressed and expanded to cool the INSIDE of the vehicle.
Antifreeze is a LIQUID that is circulated through the engine to keep the engine from melting down. When an engine is running it generates a lot of heat. If the heat is not dissipated, the engine will fail. Water is used to cool the engine and antifreeze is mixed with the water to prevent freezing in the winter and to prevent rust the rest of the time. The water/antifreeze is pumped through the engine then when the water is hot it is pumped through the radiator where it is cooled and pumped back through the engine.
How many payments can you be past due before a lender can legally repossess your vehicle?
Usually Three. Could be less in some states. In reality, one should not be any payments past due - this will definitely harm ones credit ratings for the next 7 years!!
usually it is a vacuumn problem right at the heater control switch or sometime under the hood
How do you choose a car repair shop?
Read your owner's manual to become familiar with your vehicle and follow the manufacturer's suggested service schedule.
Start shopping for a repair facility before you need one; you can make better decisions when you are not rushed or in a panic.
Ask friends and associates for their recommendations. Even in this high-tech era, old-fashioned word-of-mouth reputation is still valuable. (but consider the source)
Check with your local consumer organization regarding the reputation of the shop in question.
If possible, arrange for alternate transportation in advance so you will not feel forced to choose a facility solely on the basis of location.
Once you choose a repair shop, start off with a minor job; if you are pleased, trust them with more complicated repairs later.
Look for a neat, well-organized facility, with vehicles in the parking lot equal in value to your own and modern equipment in the service bays.
Professionally run establishments will have a courteous, helpful staff (especially the ones that are trained to build a relationship to get your trust).
The service writer should be willing to answer all of your questions.
Feel free to ask for the names of a few customers. Call them.
All policies (labor rates, guarantees, methods of payment, etc.) should be posted and/or explained to your satisfaction.
Ask if the shop customarily handles your vehicle make and model. Some facilities specialize.
Ask if the shop usually does your type of repair, especially if you need major work.
Look for signs of professionalism in the customer service area: civic and community service awards, membership in the Better Business Bureau, AAA-Approved Auto Repair status, customer service awards.
Look for evidence of qualified technicians, such as trade school diplomas, certificates of advanced course work, and ASE certifications - a national standard of technician competence.
The backbone of any shop is the competence of the technicians. ( This is a key ingredient, but the culture extended from the ownership to do the job right and do it honestly is the real backbone)
Keep good records; keep all paperwork. (If the shop is up to speed and honest, they will have everything you do on file and can remember a warrantied part.
Reward good service with repeat business. It is mutually beneficial to you and the shop owner to establish a relationship. (but on occasion get a 2nd opinion to keep them on their toes and tell them that is why you did it)
If the service was not all you expected, don't rush to another shop. Discuss the problem with the service manager or owner. Give the business a chance to resolve the problem. Reputable shops value customer feedback and will make a sincere effort to keep your business. (communication is a key if they are in the wrong they will take care of it, if they aren't they may still, but be sure you understand how a problem came about)
Ruptured or torn pre pubic tendon canine hit by truck?
What is your question? Yes - rupture of the prepubic tendon and associated herniation of abdominal contents happens with trauma and it is one of the "weakpoints" of the abdominal wall (in addition to the diaphragm and perineal areas.)
What if I sell my car and the new owner never registers it?
in most states, as long as you have a bill of sale with the date of sell, signitures and driver liscense number of the person buying, you should be OK. if the new owner never registers the vehicle, and is driving the car with false or no plates, he will eventually get caught. If the new owner gets parking tickets on the vehicle, or if the vehicle gets towed, you need to prove that you sold the vehicle by presenting the bill of sale, and proof of the person you sold the vehicle to, via liscense number, name, address ect.
On a 69 Pontiac GTO does the vacuum for distributor come from above or below the throttle plates?
your vacuum advance should hook to the outlet on the carb that sucks when you rev the engine, not to one that sucks at a idle.
On pre HEI cars, the vacuum advance actually hooked up to vacuum at idle. Below the throttle plates.
There is a fitting called a " intake vacuum fitting" which is used on the ram air model and on the basic model that when used it will provide stronger faster vacuum, be ready for a big change in off the line performance, but rougher idling.
What is the grinding noise you hear in your car when you first take off?
I had the same problem with my '93 Mercury Tracer. If you look under the hood, you should see the catalytic converter at the bottom, on top of that is a heat shield thing, just simple bend that back a bit, and it should fix the "Griding noise." At least, that's what I did to fix my problem.
