What do you need to do to sell a vehicle with a lien on it?

You (the person who still owes on the car) needs to get a payoff from your lienholder (company you are making payments to). The loan needs to be paid off (paid in full) before the lienholder will release the loan and title. If you are selling the vehicle for less than what you owe, you will need to come up with the difference. If you are selling it for more than what you owe, the lienholder will send the profit to you once the loan is paid in full. Your buyer(s) should make their payment out directly to your finance company for the full agreed dollar amount you are selling the vehicle for. The finance company will then release the title back to you (with any overage of payment) and you will need to sign off on it and present to the buyer(s). The buyer(s) then take that "clear" title to their Department of Motor Vehicles and get a title issued in their name. Be sure to get a bill of sale that both parties sign. Also, make copies of EVERYTHING just in case there is a discrepency between you (the seller) and the buyer(s). It is a slightly longer process when there is a lien involved, with with all the T's crossed and I's dotted, it can be done.

Can a judgment for an unpaid medical bill create a lien on CA property?

Any judgment, if not satisfied, can be placed as a lien upon your property.

Yes. The judgment must be recorded in the land records. If you are the creditor you should check with the court that issued the judgment to inquire about the recording practices in your state. In Massachusetts, a judgment lien is recorded by the sheriff's office.

How do you deal with the fact that the women your partner stares at then start looking at you when they notice you inthe car?

That's so rude of him! Smile at the woman or something (to show them you're not threatened and they're probably imagining him staring at them) and then... if I were you, I'd leave him. It's so disrespectful of him.

If you are building a home that will be ready for occupancy before your lease is up and you will have one month remaining on your lease can you give 30 days notice and not receive a penalty?

Yes. As you said, you only have one month to go before your move in. Hand in your notice ASAP. The worst that can happen is usually the landlord (at least in Canada) requires first and last months rent so you may lose it. You've waited this long to get into your home, so a month isn't so bad. Get that notice in! You shouldn't have to wait long as there are not enough rentals to go around in most cities and it should be natched up very quickly. Second Answer: What does your lease say? My apartment lease says I will give notice at least 60 days before the one year lease ends if I do not intend to renew it. In other words, if I gave notice 30 days before the lease ends, I would be required to lease the apartment for another month (at the one-month-at-a-time rate. (Or, in another interpretation, I might be compelled to sign for another year lease if they don't get 60 day notice.) Either way, you can bet I'll be ready with my answer 61 days in advance. But it comes back to: What are the termination clauses in your lease?

What is an equitable lien?

Cobuyer, cosigner, they are the same thing. Wherever you sign as co-signer you should be aware that if the primary borrower defaults on payments you will be held equally responsible for paying the loan.

How do you answer summons?

You don't really answer the summons, you answer the complaint that comes with the summons. The complaint will have individual paragraphs making general factual allegations, such as "defendant signed a promissory note on a car loan for $5,000." You have to write an Answer that addresses each individual allegation. They should be in numbered paragraphs to match the paragraphs in the complaint. You will either admit some allegations if they are true, deny some that are untrue and simply leave plaintiff to prove ones you are unsure of. You are also expected to raise affirmative defenses yourself. If you do not know them you should check with a lawyer to see if any apply. The danger in not raising affirmative defenses is that you might not be able to use them in your defense at a later time.
A Summons is served with a Complaint by a process server. Process is served according to the civil procedure laws of your State. Once you are lawfully served, you are considered to be on notice of the pendency of the lawsuit, even if this is constructive notice only.

The Complaint specifies the specific counts in and of the lawsuit, and asks for relief from the court. State civil procedure laws vary, but there is a limited time in which to serve an Answer on the opposing party, usually on the order of two to three weeks. If you fail to file an Answer in that time, you will have a default entered against you.

Retain an attorney at law to draft an Answer, as this is a court pleading that only an educated and experienced practitioner will know how to fully and effectively draft, file and serve. Do not prejudice your rights by being dilatory or failing to act.

If you receive a summons in a criminal matter, immediately retain an attorney at law specifically experienced in criminal practice.

Why does my motorbike keep cutting out when i put it in gear?

Answer

Does it have a safety "kick stand" switch?
It a wire grounding when you sit on it?
Loose coil wire?

Does it cut out no matter what position the throttle is in? In other words, will it stay alive if you pull in the clutch, keep the revs of the bike up, then click it into gear?

If so, this might be a clutch issue, such as a grooved clutch basket not allowing the plates to separate enough. An easy fix, if you know your way around an engine. If not, I suggest taking it to the dealer. Otherwise, try the easy fixes first, play around with the barrel adjusters on your clutch lever and see if it goes away. If it's cold outside when this happens, try running a slightly thinner transmission oil to keep the clutch pack from sticking together.

You have a used car that broke down i month after you got it you want to voluntarily repo the car but the finance company doesnt want it because it doesnt run what can you do you owe 1700 on it?

There is no such thing as a "Voluntary Repo". You borrow money to buy something , you owe the money period. If you turn the item over to the bank or finance company it doesn't take you of the hook. The bank or finance company will auction the car and you will still be responsible for the difference in the amount it sold for and the amount you owed, plus handling and fees. Even then you credit is still shot to He-- . It is not the finance companies problem that the car broke down . Your beef would be with the dealer you purchased it from. I suggest you continue to make your payments and work hard to repair the car so you can get some use out of it.

Can you lose your house after a judgment was put on your house and you have been making payments but now they want the full amount?

Depends on the wording of the contract you signed. Sometimes the ciontract has a clause stating the bank may request all payment to be paid immediatly. I've never heard of it actually happening before though.
